1. Agreement to Terms
By accessing or using MageDrop ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including those who register for an account.
2. Description of Service
MageDrop is a SaaS platform that enables Magento merchants and agencies to stage, preview, and deploy CMS content changes as coordinated releases. The Service requires installation of the MageDrop Magento module on your Magento store.
3. Accounts and Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use of your account.
You may invite team members to collaborate on your stores. You are responsible for all actions taken by members you invite.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Transmit harmful, unlawful, or objectionable content
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer or attempt to extract the source code of the Service
5. Your Data
You retain ownership of all content and data you submit to the Service, including CMS content staged through MageDrop. By using the Service, you grant us a limited licence to process your data solely to provide the Service to you.
You are responsible for ensuring you have the right to use and connect any Magento store with the Service. We do not access your Magento store beyond what is required to fulfil the intended functionality of the platform.
6. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue it at any time with reasonable notice where possible.
Scheduled deployments depend on the availability of both our platform and your Magento store. We are not liable for failed deployments caused by third-party downtime or configuration issues on your store.
7. Intellectual Property
The MageDrop platform, including its software, design, and documentation, is our intellectual property. The open-source Magento module is made available under its respective licence. Nothing in these terms transfers ownership of our intellectual property to you.
8. Limitation of Liability
To the fullest extent permitted by law, MageDrop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or damage to your Magento store.
Our total liability to you for any claim arising from these terms or the Service shall not exceed the amount paid by you (if any) to use the Service in the twelve months preceding the claim.
9. Termination
You may close your account at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data may be retained for a limited period in accordance with our data retention practices before being deleted.
10. Changes to These Terms
We may update these Terms of Service from time to time. We will notify registered users of material changes. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
